Rideshare Accidents: Trip Status, Coverage, and Evidence

Which app and insurance records matter after an Uber or Lyft collision in California?

The essential answer

What matters in this situation?

After a rideshare crash, the critical insurance question is often what the driver was doing in the app at the time. Waiting for a match, traveling to a passenger, and carrying a passenger are distinct California regulatory periods. This guide helps riders, drivers, and people in other vehicles preserve the trip record and ask careful coverage questions.

The facts and applicable law can change the next step. Use the questions below to prepare for an individualized conversation with a licensed attorney.

Practical context

Understand the issue

Preserve the trip status before the screen changes

Save the trip receipt, booking and pickup times, route map, driver name, plate, vehicle description, support messages, and any app incident number. Screenshot the relevant status with its timestamp if you are the driver; passengers should preserve the completed-trip record and communications. Photograph the vehicles, scene, and injuries as appropriate and get witness contacts. Keep originals when possible because a cropped screenshot may omit the time or context needed to understand the trip period.

The California Public Utilities Commission defines three insurance periods: app on while waiting for a match, accepted ride before pickup, and passenger aboard until exit. Coverage rules differ across those periods. The policy language and actual app status should be checked; a stated regulatory minimum is not an automatic payment or a conclusion that a platform caused the collision.

Separate liability from available insurance

First ask how the crash happened: who turned, followed, merged, or failed to see another road user. Then ask which policies may respond. CPUC says the transportation network company must provide specified primary coverage during the applicable periods, including $1 million of primary commercial coverage during accepted-trip and passenger periods and uninsured/underinsured motorist coverage during the passenger period. A personal auto policy may have rideshare exclusions. The amount potentially recoverable depends on fault, damages, policy terms, and all applicable limits.

Passengers should keep their own medical and expense records. Drivers should preserve personal and platform policy declarations, app history, and any coverage correspondence. A person in another vehicle should record the rideshare car’s plate and any evidence that the app was active. California DMV’s separate SR-1 reporting duty can apply to a driver after injury, death, or more than $1,000 property damage.

Ask who will obtain the platform records

At a consultation, ask how counsel would verify the app period, obtain trip data, identify the relevant insurers, and address a dispute about whether the driver was logged in. Ask whether the firm handles passenger, driver, and third-party claims and whether any conflict prevents representation. Also ask who will supervise the matter and which state’s rules apply. Nevada has a different rideshare statute and coverage framework, so this California period guide should not be used as a Nevada coverage opinion.

Questions that can change the analysis

Bring the most relevant records to a consultation. These prompts organize the conversation; they cannot decide a claim on their own.

  1. Was a ride accepted or a passenger aboard?

California’s regulatory coverage periods change with app and trip status.

Record to bring: Trip receipt, app timeline, support messages, and screenshots.

  2. Were you a rider, driver, or outside road user?

The evidence and potentially responsive coverages can differ by role.

Record to bring: Your position, trip documents, policy pages, and crash report.

  3. Is any insurer denying the driver was on a trip?

A status dispute calls for original timestamps and platform records.

Record to bring: Denial letter, app history, messages, and claim numbers.

Clear answers

Frequently asked questions

Is there always $1 million available after an Uber or Lyft crash?

No. CPUC requires $1 million primary commercial coverage in the accepted-trip and passenger periods, but the applicable period, liability, damages, exclusions, and policy terms still require review. A coverage minimum is not a recovery estimate.

Why does pickup time matter?

California distinguishes a driver traveling after accepting a match from a driver with a passenger aboard. Those periods can affect available coverage, especially uninsured/underinsured motorist coverage. Preserve the app’s exact timestamps and receipt.

Can a person in another car have a rideshare claim?

Potentially, depending on the driving facts and the app period. Capture the rideshare vehicle’s identity and seek the relevant insurer information. Platform status alone does not prove the driver or company caused the crash.

What should I ask the Heidari firm?

Ask how the team will verify trip status, which policies it will review, who handles contested coverage, and who would lead your case. The public firm service listing does not show an individual attorney’s history or acceptance of your matter.
